Italy Adventure Ways – Licensed Tour Operator
ART. 1 – BOOKING AND PAYMENTS
At the time of booking, a deposit of 25% of the total price is required. The remaining 75% (balance) must be paid no later than 40 days before departure. Failure to pay the balance within the specified period constitutes an express termination clause, resulting in the cancellation of the booking and the application of the cancellation charges set out in the following article.
ART. 2 – CANCELLATION BY THE CLIENT
Should you wish to cancel your booking for reasons not attributable to the organiser, the following cancellation charges will apply to the total price:
- 40 days before departure: Penalty of 30% of the total price (retention of the deposit).
- From 39 to 20 days before departure: Penalty of 50% of the total price.
- From 19 days before departure until the departure date (or No-Show): Penalty of 100% of the total price.
More than 40 days before departure: Refund of the deposit minus a flat administrative fee of € 100.00.
ART. 3 – PRICES AND SURCHARGES
All advertised prices are updated regularly; however, before final confirmation, you will receive the final price including any requested extras. Should a price increase (e.g., taxes or transport costs) exceed 8% of the total price, you have the right to cancel the trip with a full refund, provided written notice is given within 14 days of the surcharge notification. Unless otherwise stated, prices are per person based on twin-share accommodation.
ART. 4 – AMENDMENTS AND ORGANISER CANCELLATION
All booking amendments are subject to availability; requests received less than 40 days before departure may be treated as a cancellation. In the event we cancel your holiday (except for force majeure or your failure to pay), you may choose between a full refund or an alternative holiday of equivalent value.
Group tours are subject to a minimum number of participants; otherwise, we reserve the right to cancel the tour up to 4 weeks (28 days) before departure.
ART. 5 – HEALTH, FITNESS AND INSURANCE
You acknowledge that you are in suitable physical and mental condition for the chosen activities. It is a mandatory condition of booking to hold valid insurance covering medical risks, repatriation, and mountain rescue/helicopter services. If you do not hold such coverage, please contact us: we will be happy to provide specific insurance proposals tailored to your trip.
ART. 6 – LIABILITY AND EQUIPMENT
Technical equipment included (e.g., bicycles or kayaks) is provided in satisfactory condition and used at your own risk. Wearing a helmet while cycling is mandatory, as is wearing proper hiking shoes for treks. Italy Adventure Ways accepts no responsibility for injuries resulting from the failure to use mandatory safety gear. Any damage must be reported immediately to the guide or our office.
ART. 7 – COMPLAINTS AND EXCLUSION
Any dissatisfaction must be reported immediately during the trip to allow us to resolve the issue. Formal complaints must be submitted in writing within 30 days of your return. We reserve the right to exclude anyone whose conduct is dangerous or disruptive to the group. No refund will be applicable in case of exclusion for misconduct.
ART. 8 – GOVERNING LAW AND GUARANTEES
Your contract is governed by the Italian Tourism Code (articles 32-51 novies). Italy Adventure Ways holds a Civil Liability insurance policy (Company: [NAME] | Policy: [NUMBER]).
In compliance with Art. 47 of the Tourism Code, we provide financial protection for refunds and repatriation (Reference: [FUND AND REF. NUMBER]). Any dispute arising shall be subject to Italian Jurisdiction.
